Pickup Terms of Service

1. Introduction

Welcome to Pickup (“Pickup,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Pickup mobile app, website, mobile apps, and related services (collectively, the “Service”).

By creating an account, downloading the app, or using the Service, you agree to be bound by these Terms and our Privacy Policy (collectively, the “Agreement”). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Pickup.
If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms.

We may suspend or terminate accounts that violate age requirements or provide false information.

3. Account Registration and Security

To access certain features, you must create an account.
When you do so, you agree to:

Provide accurate and complete information
Maintain the confidentiality of your login credentials
Be responsible for all activities that occur under your account

You agree to notify us immediately at support@downloadpickup.com if you suspect unauthorized access or account misuse.

We reserve the right to suspend or terminate accounts that violate these Terms or our community standards.

4. SMS Text Message Consent

When you create an account, you provide your phone number and consent to receive SMS messages from Pickup for:

Account verification and security authentication
Game invitations, updates, and event notifications
Administrative and support communication

You can opt out of text messages by replying “STOP” to any message or contacting support@downloadpickup.com.
Standard message and data rates may apply.

5. Use of the Service

You agree to use Pickup only for lawful purposes and in accordance with these Terms.
You must not:

Post false, misleading, or harmful information
Harass, threaten, or abuse other users
Create multiple or fake accounts
Use the Service for commercial solicitation or advertising without permission
Attempt to hack, disrupt, or reverse-engineer the platform
Impersonate another person or misrepresent your affiliation

Violation of these terms may result in suspension or permanent account removal.

6. User-Generated Content

Pickup allows users to create, share, and post content such as photos, comments, and event descriptions (“User Content”).

By posting content, you grant Cinch Sports, Inc. a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute that content solely to operate and promote the Service.

You are solely responsible for your User Content and must ensure it does not:

Infringe on copyrights, trademarks, or privacy rights
Contain hate speech, threats, or illegal activity
Misrepresent facts or impersonate others

Pickup reserves the right to remove or moderate any content that violates these rules or our community standards.

7. Community Guidelines

To maintain a positive experience, all users must:

Respect other players and organizers
Honor commitments to games and events
Avoid discrimination, harassment, or abusive behavior
Follow all local laws and facility rules when attending games

Repeated reports of misconduct may result in suspension or permanent ban.

8. Payments and Fees

Some features (such as event hosting or premium memberships) may require payment.
All payments are processed securely by third-party payment providers (e.g., Stripe, Apple Pay, Google Pay).

You agree that:

All fees are clearly disclosed before purchase
Payments are final and non-refundable unless required by law
Pickup is not responsible for third-party transaction errors or disputes

9. Cancellations and Refunds

Event organizers may set their own refund or cancellation policies.
Pickup is not liable for refunds related to third-party events or private group payments.
If you believe you were charged in error, contact billing@downloadpickup.com within 7 days of the transaction.

10. Intellectual Property

All content, trademarks, logos, software, and materials provided by Pickup are the property of Cinch Sports, Inc. and protected by copyright and trademark laws.
You may not copy, modify, or distribute any part of the Service without our prior written consent.

11. Termination

We may suspend or terminate your access at any time if:

You violate these Terms or applicable laws
You misuse the Service or create risk for other users
We discontinue the Service

You may delete your account at any time in the app or by contacting support@downloadpickup.com.

Upon termination, the license granted to you ends immediately.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
Pickup does not guarantee that:

The Service will always be secure, error-free, or uninterrupted
User-generated content will be accurate or reliable
Events organized through the app will occur as planned

You assume full responsibility for your use of the Service.

13. Limitation of Liability

To the fullest extent permitted by law, Cinch Sports, Inc. and its affiliates are not liable for:

Any indirect, incidental, or consequential damages
Personal injury, property damage, or disputes arising from games or events organized through Pickup
Unauthorized access to your account or data

Our total liability will not exceed the amount you paid (if any) for use of the Service in the past 12 months.

14. Indemnification

You agree to defend, indemnify, and hold harmless Cinch Sports, Inc., its officers, directors, employees, and partners from any claims, damages, liabilities, and expenses arising from:

Your use or misuse of the Service
Your violation of these Terms
Your infringement of third-party rights

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
You agree that any disputes will be resolved in the courts located in Santa Clara County, California, unless prohibited by law.

16. Changes to These Terms

We may update or modify these Terms at any time.
Changes take effect upon posting the revised Terms within the app or on our website.
Continued use after such updates constitutes your acceptance of the revised Terms.
